(Also known as an agent and attorney-in-fact)

Learn More About Estate Planning

What is a Power of Attorney?

A power of attorney is a legal document that grants permission to an individual to act on behalf of another individual in specific matters.

What Does a Power of Attorney Do?

A power of attorney can grant authority to a trusted person to make essential decisions, manage finances, and take necessary actions when the person in question cannot do so themselves.

Why is a Power of Attorney Necessary?

A power of attorney can be established for various reasons, including when a person suffers from a medical condition that impairs their capacity to make decisions or when they are traveling and need someone to manage their affairs in their absence.

Powers of attorney are essential legal tools to protect the person's interests, even in challenging circumstances.

What are the Different Types of POAs?

  • Durable Power of Attorney — A type of power of attorney that remains in effect even if the person in question becomes incapacitated.

  • General Power of Attorney — A type of power of attorney that grants the agent broad authority to act on behalf of the person in various matters.

  • Health Care Power of Attorney — A type of power of attorney that grants the agent authority to make medical decisions on behalf of the person.

  • Limited Power of Attorney — A type of power of attorney that grants the agent authority to act on behalf of the person in specific, limited matters.

  • Springing Power of Attorney — A type of power of attorney that only becomes effective if and when the person becomes incapacitated.
